ALL RIGHT, SO AS THOSE OF YOU WHO'VE BEEN AROUND A WHILE KNOW THAT EVERY YEAR WE GIVE A PRESENTATION MAINLY FOR THE BENEFIT OF THE NEW MEMBERS, BUT ALSO IT'S A GOOD REFRESHER FOR OUR RETURNING COMMISSIONERS, JUST BASICALLY WHAT THE PLANNING ZONING COMMISSION DOES AND SOME OF THE RULES, REGULATIONS, PROCEDURES, AND YOU KNOW WHY WE DO WHAT WE DO AND HOW WE DO IT. SO THE OVERALL AUTHORITY OF THE PLANNING AND ZONING COMMISSION IS TO PROTECT THE HEALTH, SAFETY AND WELFARE OF THE CITIZENS OF WYLIE. WE DO THAT BY THREE DIFFERENT THINGS. IN BIG PICTURE IS THE ZONING AUTHORITY, WHICH IS LEGISLATIVE IN NATURE, WHICH MEANS THAT THERE IS LOTS OF OPTIONS FOR YOU ALL. WHENEVER YOU HEAR ME SAY THAT SOMETHING IS LEGISLATIVE, THAT MEANS THAT WE'RE MAKING A LAW. WHEN I SAY WE MAKING, YOU'RE GOING TO RECOMMEND TO CITY COUNCIL. CITY COUNCIL IS THE ONLY BODY WITHIN THE CITY THAT HAS THE AUTHORITY TO ACTUALLY MAKE THE LAW. BUT THIS COMMISSION HAS THE AUTHORITY TO PRESENT POTENTIAL LAWS TO THE CITY COUNCIL.

THERE'S SUBDIVISION AUTHORITY, WHICH IS MINISTERIAL. ANOTHER WAY TO LOOK AT THAT IS ALSO ADMINISTRATIVE. THOSE ARE PLATS AND SITE PLANS. THOSE ARE THINGS THAT, YOU KNOW, WHAT IF THEY'RE GENERALLY CORRECT. CORRECT. STATE LAW SAYS WE HAVE TO APPROVE THEM. THAT DOESN'T MEAN WE CAN'T DIG DOWN IN THE DETAILS. THAT DOESN'T MEAN WE CAN'T ASK DEVELOPERS. I'M GETTING WAY AHEAD OF MYSELF, SO I'M GOING TO SKIP SOME STUFF, PROBABLY LATER ON. WELL, YOU ARE ALL INVOLVED IN IN ONE FORM OR FASHION, BUT A COUPLE OF YOU WERE INVOLVED IN THE MONTHLY MEETINGS THAT WE HAD WHILE WE WERE PUTTING THAT THING TOGETHER OVER THE COURSE OF A YEAR. THE PNC COMMISSION IS MANDATED FOR ALL HOME RULE CITIES. THAT'S EVERY CITY. THAT'S NOT A GENERAL LAW CITY IS THE OTHER SIDE OF THAT. JUST A LITTLE EDUCATION. FOR THOSE OF YOU WHO DON'T KNOW, A GENERAL LAW CITY IS A CITY THAT JUST USES WHATEVER THE STATE OF TEXAS HAS. THEY DON'T HAVE ANY OF THEIR OWN RULES OR REGULATIONS. THOSE ARE MOSTLY YOUR SMALL TOWNS THAT HAVE JUST BEEN INCORPORATED ARE MOSTLY LIKE THOSE. BUT ONCE YOU MAKE YOUR OWN ORDINANCES, YOU KNOW THAT ADD TO OR VARY FROM THE STATE LAW WE'RE ALLOWED. THEN YOU HAVE TO HAVE A P AND Z COMMISSION. OURS WAS ORIGINATED IN 1956 AND WAS INCLUDED IN THE 85 CHARTER. AND KIND OF COOL THING IS, IT IS THE ONLY NON-COUNCIL GROUP THAT HAS ITS OWN SECTION WITHIN THE CHARTER. ZBOA, H, R, C, P. THE OTHER BOARD BOARDS AND COMMISSIONS DO NOT HAVE A SECTION IN THE CHARTER. RULES AND PROCEDURES.

I SENT YOU ALL THAT EMAIL WHEN I WAS WELCOMING OUR NEW COMMISSIONERS. IT'S ATTACHED TO THAT. THAT JUST BASICALLY TALKS ABOUT ALL THE DIFFERENT THINGS THAT WE HAVE TO ABIDE BY AS WE'RE HOLDING OUR MEETINGS. I'LL GO OVER THAT A LITTLE MORE IN DETAIL HERE IN A FEW MINUTES.

IT HAS TO ULTIMATELY BE APPROVED BY CITY COUNCIL. WE HAVE HAD TWO UPDATES RECENTLY, 1 IN 2020 AND THEN ONE LAST YEAR. SO THE ROLES AND RESPONSIBILITIES I KIND OF HIT ON THESE, BUT THESE ARE THE FIVE BIG ONES. ZONING CHANGES, PLAT SITE PLANS, ORDINANCE AND REGULATION AMENDMENTS AND LAND USE PLAN. I'LL GO INTO THOSE IN MORE DETAIL HERE AS WE GO ALONG.

ZONING CHANGES. THESE ARE WHEN SOMEBODY COMES IN AND SAYS, YOU KNOW, I KNOW THE ZONING ORDINANCE SAYS OR THE ZONING MAP SAYS THIS, YOU KNOW, SAY COMMERCIAL CORRIDOR, BUT I WANT TO DO A LIGHT INDUSTRIAL HYPOTHETICALLY ON IT. THEY NEED TO COME TO YOU ALL AND GET A RECOMMENDATION THAT GOES TO CITY COUNCIL. THOSE CHANGES ARE GENERALLY GOVERNED BY THE LAND USE PLAN. THAT'S WHY WE SPEND ALL THAT TIME, MONEY AND EFFORT MAKING THAT PLAN. HOWEVER, THAT THE LAND USE PLAN IS, I'LL TALK ABOUT HERE IN A MINUTE, IS A GUIDE. IT DOESN'T NECESSARILY MEAN WE HAVE TO STICK TO IT. MAIN REASON IS WE ONLY UPDATE THAT THING ABOUT EVERY 5 TO 10 YEARS, AND THINGS CAN CHANGE PRETTY FAST. YOU KNOW, I'VE BEEN HERE IN THIS JANUARY, I'LL HAVE BEEN HERE 20 YEARS. WE'VE DONE TWO LAND USE LAND USE PLANS. WHEN I FIRST STARTED, WILEY WAS 15,000 PEOPLE. SO, YOU KNOW, A LAND USE PLAN FOR 15,000 PEOPLE WOULDN'T BE MUCH GOOD FOR WHAT WE GOT SITTING OUT THERE NOW. SO THEY'RE UPDATED ON A SOMEWHAT REGULAR BASIS. THE ZONING CHANGES COVERS ALLOWED. USE P AND Z MAKES A RECOMMENDATION TO COUNCIL. THAT'S REALLY IMPORTANT THAT YOU UNDERSTAND THAT. THAT GIVES YOU GUYS A LOT OF AUTHORITY IN THAT IF YOU MAKE A DECISION AND SAY YOU RECOMMEND DENIAL, COUNCIL HAS TO HAVE A SUPERMAJORITY TO OVERCOME THAT DENIAL. SO IT'S IMPORTANT TO KEEP THAT INTO CONSIDERATION. AS YOU KNOW, YOU'RE MAKING YOUR DECISIONS AND IT'S LEGISLATIVE IN NATURE.

WHAT THAT MEANS IS THAT THIS BECOMES LAW, WHICH ALSO MEANS YOU CAN ASK FOR ANYTHING WHEN THERE'S A ZONING CHANGE THAT IS A PD OR AN SUP. IF IT'S A STRAIGHT ZONING, YOU CAN'T, YOU KNOW, IF IT'S JUST SOMEBODY WANTS TO GO, I WANT TO GO. THIS IS CURRENTLY COMMERCIAL CORRIDOR. I WANT TO GO TO LIGHT INDUSTRIAL, BUT THEY'RE DOING STRAIGHT ZONING. THEN OBVIOUSLY IT'S JUST A YES OR NO ANSWER ON THAT. IF THEY'RE DOING A PLANNED DEVELOPMENT OR SPECIAL USE PERMIT, YOU CAN ASK FOR A LOT MORE THINGS THAT ARE WITHIN THE THE LETTER OF THE LAW. AND IF YOU GOT ANY SPECIFIC QUESTIONS ABOUT THAT, LET ME KNOW. BUT OTHER THAN THAT, DURING THE COURSE OF THE MEETING, I WILL DEFINITELY TELL YOU THAT, HEY, WHAT YOU'RE ASKING FOR IS ILLEGAL TO DO. ONE EXAMPLE WOULD BE YOU CAN'T ASK FOR IMPROVEMENTS THAT ARE OFF SITE AS A CONDITION OF OF APPROVING THE ZONING. IT HAS TO BE TIED TO THAT LAND IN ORDER TO BE ABLE TO MAKE THAT. THAT'S JUST ONE GENERAL EXAMPLE. PLATS. THESE ARE BASICALLY JUST DRAWN THE LOT LINES. SO WE'RE GOING TO HAVE A DRAINAGE EASEMENT, YOU KNOW, GO IN THAT DIRECTION AND WE MAY HAVE A DETENTION POND ON THE OPPOSITE SIDE, YOU KNOW, FROM WHERE

ACTUALLY THE SAME SIDE IS WHERE ALL THE WATER IS GOING, THAT SORT OF THING. IT'S JUST SHOWING THAT THE WHAT IS BEING PROPOSED, IT'S ESTABLISHING THE LOT. AND THEN IT'S ALSO SHOWING THAT WHAT WHAT'S PROPOSED IS ACTUALLY BUILDABLE. THIS IS A RECOMMENDATION TO COUNCIL. THIS IF P AND Z RECOMMENDS DENIAL, THIS DOES NOT TAKE A SUPERMAJORITY OF COUNCIL. THAT BEING SAID, P AND Z NEEDS TO HAVE A REALLY GOOD REASON WHY THEY WOULD DENY THIS. NOT SAYING YOU CAN'T. NOT SAYING IT HASN'T HAPPENED BECAUSE THESE ARE GENERALLY, GENERALLY ADMINISTRATIVE OR ADMINISTERIAL IN NATURE. WE AS STAFF HAVE AT TIMES RECOMMENDED DENIAL ON SOMETHING JUST BECAUSE IT'S NOT COMPLETE. AND THAT'S USUALLY THE ONLY TIME WE RECOMMEND DENIAL ON SOMETHING, ON A PLAT, IS WHEN WE'VE ASKED FOR INFORMATION AND THE APPLICANT JUST CANNOT GET IT TO US IN TIME, OR DOES NOT WANT TO MAKE A CHANGE FOR WHATEVER REASON.

AND WE'LL WHEN WE DO THAT, WE HAVE TO POINT TO A PART IN THE SUBDIVISION ORDINANCE BECAUSE STATE LAW SAYS WE HAVE TO SHOW THEM THIS IS WHY WE'RE DENYING IT. WE CAN'T JUST SAY WE DON'T LIKE THIS BECAUSE, YOU KNOW, WE DON'T LIKE IT, WHICH IS WHAT YOU CAN DO WITH THE ZONING ORDINANCE. YOU CAN LITERALLY SAY, I DON'T THINK THAT'S A GOOD DEVELOPMENT, AND THAT'S GOOD ENOUGH REASON. YOU DON'T HAVE TO GET SPECIFIC ON THAT ON THESE. WE HAVE TO GET VERY SPECIFIC ON WHY, AND WE HAVE TO MENTION ALL THE THINGS THAT ARE WRONG WITH IT. IF WE WANT TO RECOMMEND DENIAL, BECAUSE IF WE SAY WHAT'S WRONG, IF WE ONLY LIST TWO THINGS, IF THEY FIX THOSE TWO THINGS BY STATE LAW, THEN IT HAS TO BE APPROVED. WHETHER WE FIND MORE THINGS LATER ON OR NOT DOESN'T MATTER AT THAT POINT, WHICH IS WHY WE HAVE 3 OR 4 DIFFERENT STAFF MEMBERS THAT LOOK AT THESE THINGS OVER AND OVER AND OVER AGAIN TO MAKE SURE WE HOPEFULLY DON'T RUN INTO THOSE SITUATIONS. SITE PLANS. THESE ARE AFTER THE LOTS ESTABLISHED WITH THE PLAT.

THIS IS THE ACTUAL FOR A COMMERCIAL BUILDING. THIS DOESN'T HAPPEN FOR RESIDENTIAL BUILDINGS, BUT FOR COMMERCIAL BUILDING. THIS IS. WHERE THE ACTUAL WELL PLAN FOR THE SITE GOES. THAT COVERS BULK AND ARCHITECTURAL REQUIREMENTS. FOR THOSE OF YOU, YOU KNOW WHAT IS A BULK REQUIREMENT THAT'S BUILDING SIZE, BUILDING HEIGHT? HOW MUCH OF THE LAND DOES THE ACTUAL BUILDING COVER? YOU KNOW, BASED ON THE LOT SIZE, ACCESS, PARKING, LANDSCAPING, THESE ARE APPROVED BY P AND Z. THEY DO NOT GO ON TO COUNCIL. AND THESE ARE ALSO, I'M SORRY, MINISTERIAL OR ADMINISTRATIVE IN NATURE. THAT MEANS THAT AS LONG AS THEY MEET ALL OF OUR REQUIREMENTS, P AND Z PRETTY MUCH HAS TO APPROVE IT. AGAIN, I'M GOING TO GO BACK TO WHAT I SAID EARLIER. THAT DOESN'T MEAN THAT YOU CAN'T ASK THE DEVELOPER FOR CERTAIN THINGS AND SAY, YOU KNOW WHAT? I REALLY DON'T LIKE THIS BECAUSE YOU KNOW OF WHATEVER. I KNOW WE'VE HAD A CONVERSATION, LIKE WHEN SOMEBODY HAD A DRIVE THROUGH THAT KIND OF EMPTIED OUT INTO WHERE OTHER PEOPLE WERE GOING TO BE COMING IN OFF OF THE ROAD. DO YOU ALL REMEMBER THAT WE'VE HAD 1 OR 2 OF THOSE? AND SO WE SAID, HEY, CAN YOU ADD, YOU KNOW, SOME SIGNAGE OR MAYBE MOVE THE DRIVE THROUGH WHERE IT, IT, IT ANGLES A LITTLE BIT AWAY FROM THAT OR SOMETHING LIKE THAT. THAT DOESN'T MEAN THEY HAVE TO 100% DO THOSE SORTS OF THINGS, BUT IT NEVER HURTS TO ASK. ORDINANCE AND REGULATION AMENDMENTS. THIS IS ANYTHING WHERE WE'RE GOING TO CHANGE A CITY ORDINANCE OR A ZONING ORDINANCE. THESE CAN BE INITIATED IN A LOT OF WAYS. SOMETIMES STAFF WERE LIKE, YOU KNOW WHAT? WE'VE DONE SOME RESEARCH AND THIS IS OUTDATED OR DOESN'T MAKE SENSE ANYMORE, OR WE'RE GETTING A LOT OF REQUESTS FOR THIS PARTICULAR USE AND WE DON'T HAVE THAT USE IN HERE. SO LET'S GO AHEAD AND BRING IT TO THE PNC COMMISSION OR COUNCIL AND SEE WHAT THEY THINK. SO OR PNC COMMISSION CAN THINK OR DO THE SAME THING. AND SO DOES CITY COUNCIL. THERE'S A STANDS FOR ZONING BOARD OF ADJUSTMENTS. THEY'RE THE FOLKS THAT GIVE FOLKS GIVE PROPERTY OWNERS VARIANCES. EVERY ONCE IN A WHILE THEY'LL APPROVE A BUNCH OF VARIANCES. AND AT THAT POINT, STAFF WILL SAY SOMETHING ALONG THE LINES OF, SINCE WE'RE DOING THIS MANY VARIANCES, WHAT IF WE JUST WENT AHEAD AND CHANGED THE CITY ORDINANCE SINCE WE, YOU KNOW, WILL APPROVE THOSE? USE AN EXAMPLE FROM SEVERAL YEARS BACK. WE USED TO REQUIRE THAT ALL PATIO COVERS BE THE SAME SETBACK, THE REAR SETBACK, IN OTHER WORDS, THE SAME DISTANCE FROM THE REAR PROPERTY LINE AS THE BUILDING WAS NOT TO SAY THAT IT HAD TO BE BUILT WHERE THE BUILDING WAS. IN OTHER WORDS, IF YOUR REAR SETBACK WAS 25FT AND SO YOU HAD TO HAVE 25FT FROM THE REAR OF YOUR BUILDING TO YOUR PROPERTY LINE.

NORMALLY THAT'S WHERE THE FENCE IS. IF YOU'RE BUILDING WAS 30FT FROM THE LINE, THAT MEANS YOU COULD ONLY BUILD A FIVE FOOT PATIO. IF IT WAS 25FT, YOU COULDN'T BUILD A PATIO. WELL, THE ZONING BOARD OF ADJUSTMENTS KEPT HANDING OUT VARIANCES FOR THOSE, AND RIGHTFULLY SO. YOU KNOW, 25FT IS A LONG WAY TO HAVE, YOU KNOW, JUST AN OPEN, EMPTY BACKYARD IF THAT'S NOT THE WAY YOU WANT IT. AND ESPECIALLY AS WE MOVED ON OVER TIME, WHERE PEOPLE ARE OKAY WITH SLIGHTLY SMALLER YARDS, AS LONG AS THEY HAVE THE ENTERTAINMENT IN THEIR HOUSE, THEN THEY CAN HAVE A FEW PEOPLE OUT BACK. MOST PEOPLE, YOU KNOW, THE NEIGHBORHOOD POOL HAS

THOSE ARE LEGISLATIVE IN NATURE, AND THAT MEANS THAT WE CAN, WITHIN THE THE CONFINES OF STATE LAW, PRETTY MUCH INTRODUCE WHATEVER WE WANT TO DO, AS LONG AS IT'S WITHIN THE RIGHTS OF THE HELM.
