GOOD EVENING. OUR FIRST ITEM ON THE REGULAR AGENDA IS A SITE PLAN REQUEST BY WYLIE ISD. WHAT THEY'RE ASKING FOR ARE IMPROVEMENTS TO THE EXISTING AG CENTER THAT'S LOCATED AT 1301 HENSLEY LANE. SO THESE ARE THE CURRENT CONDITIONS OF THE BUILDING GENERALLY WHERE MY MOUSE IS. AND WHAT THEY'RE ASKING FOR IS FOR AN EXPANSION OF THE ACTUAL AG CENTER BY ADDING A NEW SHOW AREA, NEW CATTLE TURNOUT, AND A NEW PIG BORN. IN ADDITION TO THIS, THEY ARE ALSO BUILDING A NEW CTE BUILDING WITH A NEW GREENHOUSE. AND FOR ACCESS, THEY ARE PROVIDING A FIRE LANE THAT'S GOING TO LOOP AROUND ALL OF THE STRUCTURES. WITH THIS DEVELOPMENT, THEY WERE REQUIRED TO PROVIDE A SECONDARY POINT OF ACCESS AS WELL, SINCE THE SITE CURRENTLY ONLY HAD ONE. AND FOR THAT THEY'RE GOING TO HAVE TO. GET A SHARED ACCESS EASEMENT OR A MUTUAL ACCESS EASEMENT, CROSS ACCESS EASEMENT TO ON THE PROPERTY TO THE SOUTH. WITH THIS DEVELOPMENT, THEY'RE PROVIDING 130 PARKING SPACES, AND TEN OF THEM ARE ADA ACCESSIBLE. THE SITE PLAN DIDN'T PROVIDE ANY ON SITE DETENTION. SO WITH THE CIVIL PLANS, THEY'RE GOING TO HAVE TO PROVE THAT THEY DIDN'T HAVE TO PROVIDE IT OR THAT IT'S NOT

OUR SECOND ITEM ON THE AGENDA IS A IT'S A PUBLIC HEARING REQUEST FOR A ZONING CASE FOR A SPECIAL USE PERMIT TO ALLOW FOR A FUELING STATION AND A CONVENIENCE STORE AT THE NORTHEAST CORNER OF COUNTRY CLUB ROAD AND PARK BOULEVARD. THE STRUCTURE MEASURES APPROXIMATELY 5000FT■!S. WITH THIS PROPOSAL, THEY'RE ALSO SHOWING THE POTENTIAL DEVELOPMENT OF TWO ADDITIONAL RETAIL BUILDINGS. BUT THAT'S NOT PART OF THIS SCOPE, NECESSARILY. THEY ARE REQUESTING A WAIVER TO THE 300 FOOT DISTANCE REQUIREMENT FROM A SCHOOL FOR THE SALE OF ALCOHOL AND SMOKING PRODUCTS, WITH THE SPECIAL USE PERMIT, WE HAVE ADDED THOSE CONDITIONS, BUT THERE ARE ALSO LIMITATIONS TO THE TYPE OF SMOKING PRODUCTS THAT WOULD BE ALLOWED. ESSENTIALLY, IT'S CIGARETTES AND CIGARS ONLY. THEY CAN'T HAVE VAPING OR CBD TYPE PRODUCTS. SINCE TODAY WE'VE RECEIVED NINE NOTIFICATIONS OR IN OPPOSITION, BUT ONLY I BELIEVE FOUR OF THEM WERE WITHIN THE AREA. ACTUALLY, YEAH. FOR THE ONES THAT HAVE X'S ON THERE, I ALSO PRINTED THE PUBLIC COMMENT FORMS. IF ANYONE WAS CURIOUS TO SEE ALL OF THEM, THEY'RE HERE. I CAN PASS IT AROUND. SO THEY KEPT TRICKLING IN ALL WEEK. IN GENERAL, THIS TYPE OF DEVELOPMENT IS CONSISTENT WITH THE LAND USE PLAN, WITH IT BEING IN THE LOCAL COMMERCIAL SECTOR. AND WITH THAT, I'LL BE HAPPY TO ANSWER ANY QUESTIONS.

WE ALSO MADE SURE TO STATE IN THE REPORT THAT IT'S ONLY ONE FUELING STATION AND CONVENIENCE STORE THAT THEY'RE ALLOWED, RIGHT, BECAUSE THE SITE IS PRETTY BIG, RIGHT? SO WE MADE SURE THAT IT'S ONLY BUILDING ONE ON THE SITE THAT WOULD BE ALLOWED TO HAVE THIS TYPE OF USE. THE REST OF THE BUILDINGS WOULD HAVE TO HAVE USES THAT USES THAT ARE ALREADY ALLOWED IN THE NEIGHBORHOOD SERVICES DISTRICT. SINCE THAT'S THE CURRENT ZONING AND THIS.

THE LAND IS CURRENTLY ZONED COMMERCIAL CORRIDOR, BUT THEY NEED THE SPECIAL USE PERMIT TO ALLOW FOR AUTOMOBILE REPAIR FOR AN AUTOMOBILE REPAIR SHOP. THIS IS THE CONCEPTUAL PLAN AS WELL, SINCE THEY ARE GOING TO BE REQUIRED TO SUBMIT A SITE PLAN LATER ON WITH THIS REQUEST. THEY ARE ALSO ASKING TO BE ALLOWED TO HAVE THE LOADING DOORS FACE THE RIGHT OF WAY. PARKER ROAD. THEY HAVE ADDED A NOTE AND ACKNOWLEDGED THAT THEY WILL PROVIDE ADDITIONAL SCREENING TO SHIELD THE THE GARAGE DOORS. AND IN GENERAL, THIS CONCEPTUAL PLAN WOULD PASS IF IT WAS A SITE PLAN, THEY JUST DIDN'T HAVE THE REQUIRED PRELIMINARY ENGINEERING AND ELEVATIONS AS WELL FOR THE DEVELOPMENT. SO IT'S A GOOD LOOK AT WHAT IT WILL BE. WE DID MAIL TEN

THE LAND ITSELF IS ALREADY ZONED COMMERCIAL, EVEN THOUGH THE COMPREHENSIVE LAND USE PLAN HAS THIS AREA AS LOW DENSITY. BEFORE THE COMPREHENSIVE PLAN WAS ADOPTED, THE NEW ONE THAT WE HAVE, IT DID COMPLY WITH THE GENERAL URBAN SECTOR. IT'S JUST BE IT WAS JUST LISTED THE WAY IT IS BECAUSE THE AREA IS ADJACENT TO IT ARE STILL AG SO IT WAS ALL CLASSIFIED AS LOW LOW DENSITY SECTOR, RIGHT. SO. TECHNICALLY IT'S NOT IN COMPLIANCE WITH THE CURRENT COMP PLAN, BUT IT WAS TO THE PREVIOUS ONE. SO THAT'S THAT'S WHAT IT IS. BUT WE DID, WE DID LOOK AT THE RESIDENTIAL LIKE ADJACENCY OF THE STRUCTURE AND PRETTY MUCH WHERE THEY'RE PLACING THE BUILDING IS FAR AWAY FROM THE SUBDIVISIONS TO THE SOUTH. THAT'S DOWN THERE BECAUSE THE BUILDING IS GOING TO BE UP HERE, RIGHT? SO THE TWO PLACES ON EITHER SIDE ARE RESIDENTS. YES. BUT THE THE PROPERTY OWNER OF THIS SITE OWNS THE PROPERTY TO THE WEST.

ZC2026-04 STAFF. SO EARLIER THIS YEAR, WE MET WITH BOTH THE PLANNING AND ZONING COMMISSION AND WITH CITY COUNCIL WITH WORK SESSIONS TO DISCUSS ZONING ORDINANCE AMENDMENTS FOR LAND USE. AND THESE ARE THE ACTUAL AMENDMENTS THAT WE'RE PROPOSING. ESSENTIALLY, ALL DRIVE THROUGH BUSINESSES ARE GOING TO BE REQUIRED TO DO SPECIAL USE PERMITS, AND THAT'S GOING TO BE COVERED WITHIN ITS OWN SECTION. AND WE'VE ADDED NEW USES LIKE EVENT CENTER USE, DRONE DELIVERY STATION AND DATA CENTERS. WE'VE ALSO REMOVED SOME USES THAT AREN'T APPLICABLE ANYMORE, SUCH AS A MINING USE. AND THAT'S, THAT IS THAT DOESN'T COME UP AS OFTEN.

AND WE MADE TEXAS LAW REQUIREMENTS CHANGES FOR THE HOME OCCUPATION PROVISIONS. AND LASTLY, THIS WAS RECOMMENDED BY THE PLANNING AND ZONING COMMISSION TO REQUIRE A SEXUALLY ORIENTED BUSINESSES TO HAVE SUPS REGARDLESS IF THEY'RE IN HEAVY INDUSTRIAL AND LIGHT INDUSTRIAL, JUST IN CASE THAT LAND IS EVER SOLD. SO WITH THIS REQUEST, IT DIDN'T REQUIRE A NOTIFICATION LIKE TO CITIZENS LIKE THROUGH THE MAP, BUT WE DID HAVE TO POST IT IN THE NEWSPAPER. SO WITH THAT, I'LL BE HAPPY TO ANSWER ANY QUESTIONS. HAS THERE BEEN ANY FEEDBACK SINCE IT'S BEEN POSTED INTO THE PAPER? NO, NO TO THE CITY COUNCIL. AND YEAH, REALLY OUR PURPOSE FOR DOING THIS WAS JUST TO KIND OF UPDATE OUR ORDINANCE, SINCE IT'S BASED ON THE 2003 ORDINANCE THAT WE HAVE, AND IT ADDS NEW USES THAT WE SEE A LOT OF PEOPLE WANT THEIR DEVELOPERS, BUT IT ALSO GIVES THE CITY CONTROL BY LIMITING THEM THROUGH SPECIAL USE PERMITS. YEAH. CAN WE MAKE THE DATA CENTER 10,000FT■!S LIKE WE DID THE ONE PLACE? YEAH. I MEAN, THAT'S ACTUALLY THAT WAS APPROVED AT 34,000. YEAH. THERE WAS ONLY ONE COUNCIL MEMBER THAT WANTED IT AT TEN. WELL, I SHOULDN'T SAY IT THAT WAY, BUT THERE WAS A COUNCIL MEMBER THAT WANTED IT AT TEN AND EVERYBODY ELSE WAS OKAY WITH THE LARGER SIZE. YEAH. AND WE JUST HAVE IT WRITTEN IN A WAY WHERE THE CUMULATIVE AREA, IF IT'S OVER 25,000, THAT'S WHEN IT WOULD TRIGGER THE S P. SO IF THEY HAD MULTIPLE 10,000 BUILDINGS, IT WOULD BE THE BIG, THE BIG TAKEAWAY FROM THAT PART OF IT, BECAUSE I KNOW THAT'S WHAT, YOU KNOW, SOME PEOPLE, A LOT OF FOLKS WERE WORRIED ABOUT, WAS THAT WHAT WE'RE TRYING TO LIMIT IT TO IS NORMAL USE OF UTILITIES. YES. THAT'S WHAT I WANT. YEAH. IF THEY HAVE TO PUT A SUBSTATION IN OR, YOU KNOW, THERE'S A WHOLE OTHER WATER ISSUE OR ALL THAT, THEN THAT'S GOING TO PRETTY MUCH KIND OF GO OUT THE WINDOW, YOU KNOW, OR IT'S GOING TO TAKE A WHOLE LIKE A PLANNED DEVELOPMENT AS OPPOSED TO JUST A SPECIAL USE PERMIT. SO THAT HELPS, YOU KNOW, JUST KEEP IT TO BASICALLY WHAT WOULD BE A GLORIFIED SERVER ROOM AS OPPOSED TO AN HONEST TO GOD TRUE DATA CENTER. YEAH. YOU KNOW.
