ARE THERE ANY CITIZENS PRESENT THAT WOULD LIKE TO ADDRESS THE BOARD ON ANY NON AGENDA ITEMS, SEEING THAT THAT THERE ARE NONE, WE'LL GO AHEAD AND MOVE TO OUR CONSENT AGENDA. WE HAVE ONE ITEM ON OUR CONSENT AGENDA AND THAT IS TO APPROVE THE MINUTES FROM THE SEPTEMBER 15TH MEETING LAST MONTH. AND SO I WILL TAKE A MOTION IF ANYONE WOULD LIKE TO DO THAT. MR. IS TO HOLD THE PUBLIC HEARING, TO CONSIDER AND ACT UPON A REQUEST BY DEREK AND CHRISTINA WAGNER FOR A VARIANCE TO SECTION 25.4 OF ZONING OR ZONING ORDINANCE, 1991 DASH 22 TO ALLOW FOR AN ACCESSORY STRUCTURE OVER THE MAXIMUM ALLOWED SQUARE FOOTAGE AND OVER THE ALLOWED ACCESSORY BUILDING HEIGHT. THE PROPERTY IS LOCATED AT 1903 STONE CREST TRAIL, ZBA NUMBER 20 2514 MR. MERLINO YES. GOOD EVENING. THE APPLICANT IS REQUESTING A VARIANCE TO ALLOW FOR 1300 SQUARE FOOT ACCESSORY STRUCTURE THAT WILL FUNCTION AS A GARAGE SLASH WORKSHOP. THERE IS ALREADY AN EXISTING ACCESSORY STRUCTURE ON THE LOT THAT MEASURES 240 OR 204FT■!S, WHICH PUTS THE ACCESSORY STRUCTURES LOT COVERAGE OVER WHAT'S MAXIMALLY ALLOWED. AND THIS IS ALSO WITHIN A PD THAT THE PLANNED DEVELOPMENT THAT WAS APPROVED IN 1991, THE RIVERCHASE PLANNED DEVELOPMENT, WHICH ALSO HAS A MAXIMUM ACCESSORY STRUCTURE, LOT ACCESSORY STRUCTURE SIZE OF 600FT■!S. SO THE APPLICANT HAS ACQUIRED A LETTER FROM THE HOMEOWNERS ASSOCIATION SAYING THAT THEY'RE OKAY WITH IT, PENDING PERMITTING FROM THE CITY. IT IS IN COMPLIANCE WITH ALL OTHER REQUIREMENTS. IN TERMS OF SETBACKS. THERE'S A FIVE FOOT SIDE SETBACK FROM THE PROPERTY LINE. AND THEN HERE'S AN IMAGE OF WHAT IT LOOKS LIKE.
SO AT THE WALLS IT'S 12FT IN HEIGHT, BUT AT THE VERY PEAK IT'S 15FT THREE INCHES. SO THAT'S HOW IT GOES OVER THE 15FT. IT ISN'T TWO STORIES, IT'S ONE STORY. SO AND IT DOESN'T HAVE A WINDOWS ON THE SECOND FLOOR OR ANYTHING LIKE THAT. WE DID MAIL NOTICES TO 12 PROPERTY OWNERS AND WE RECEIVED THREE IN FAVOR. AND THAT'S WHAT THESE CHECK MARKS ARE RIGHT HERE. SO TWO WERE FROM THE SAME LOT FROM THE SAME RESIDENTS. AND THEN ONE WAS FROM THE PROPERTY OWNER THEMSELVES. AND THEN THIS IS THE LETTER FROM THE HOA. SO WE HAVE SEEN VARIANCES LIKE THESE IN THE PAST FROM THIS SPECIFIC PLAN DEVELOPMENT. AND THAT'S MOSTLY DUE ■TO THAT 600 SQUARE FOOT LIMITATION THAT ACCESSORY STRUCTURES HAVE. NOTE THAT THE LOT IS ALSO 20,000. IT'S MORE THAN 20,000FT■!S IN SIZE, WHICH IT'S A FAIRLY BIG LOT COMPARED TO CITY'S LOT SIZES. SO AND ONE OTHER THING THAT WE DIDN'T PUT IN THE REPORT AND WE PROBABLY SHOULD HAVE WAS BECAUSE, YOU KNOW, IT NEEDS TO BE A UNIQUE CIRCUMSTANCE AND NEVER SAY NEVER. BUT THIS DOES BACK UP TO A FLOODPLAIN. SO THE I THEM EVER HAVING NEIGHBORS DIRECTLY BEHIND THEM IS PROBABLY VERY, VERY SLIM. YEAH. AND MR.
