WE HAVE PEOPLE WHO STRUGGLE WITH PUTTING FOOD ON THEIR TABLE. MY OPENING CHALLENGE TO EVERYONE HERE AND TO ANYONE WHO MAY WATCH OR LISTEN TO THIS, IS AS YOU ENTER THIS TIME OF BOUNTIFUL PLENTY WHERE WE ARE APPROACHING THANKSGIVING. I'M HERE TODAY TO DISCUSS A CRITICAL ISSUE REGARDING THE CULVERTS ON TRIBUTARY ONE OF RUSH CREEK AT EAST STONE ROAD, LOCATED IN THE SOUTHWEST PORTION OF OUR PROPERTY. THESE CULVERTS WERE PLACED OVER 50 YEARS AGO WHEN THE ROAD WAS FIRST BUILT. THEY WERE DESIGNED TO MANAGE WATER RUNOFF FROM EXTENSIVE FARMLANDS. HOWEVER, IN THE PAST DECADE WE HAVE WITNESSED A SUBSTANTIAL TRANSFORMATION OF THESE FARMLANDS INTO IMPERVIOUS SURFACES DUE TO URBAN DEVELOPMENT. AS A RESULT, THERE HAS BEEN AN EXPONENTIAL INCREASE IN THE VOLUME OF WATER BEING DIVERTED INTO THESE CULVERTS. THERE THEY WERE ADEQUATE FOR AGRICULTURAL RUNOFF, BUT THEY ARE NOW SEVERELY UNDERSIZED TO ACCOMMODATE THE SIGNIFICANTLY HIGHER WATER FLOW RESULTING FROM THE URBANIZATION. THIS INADEQUACY POSES A RISK TO PUBLIC PROPERTY. THE ENGINEER THAT DID THE POST HYDROLOGY STUDY FOR BOZEMAN FARMS STATED THAT THE CULVERTS THERE WERE WILDLY UNDERSIZED AS THE WORDS THAT HE USED WHEN THE EASTERN ROAD PROJECT WAS INITIALLY PLANNED, THE PROJECT'S ENGINEER INFORMED US THAT THE CULVERTS WOULD BE UPSIZED TO AN APPROPRIATE SIZE TO ACCOMMODATE THE INCREASED STORMWATER DRAINAGE. HOWEVER, WHEN WE RECENTLY SPOKE WITH TAN AND THE CITY ENGINEERING DEPARTMENT, HE SAID THAT DUE TO BUDGET CONSTRAINTS, THE CULVERTS WERE NOT TO BE UPSIZED AND WOULD BE REPLACED WITH CULVERTS OF THE SAME SIZE, THE SAME CULVERTS WERE PLACED CIRCA 1960. IT IS NOW 2024. SO NOW WE HAVE THIS GIANT DRAINAGE POINT THAT REALLY CULMINATES RIGHT THERE ON EAST STONE ROAD. WE RECENTLY DISCUSSED WITH THE ENGINEER THAT'S DOING THE NEW JUNIOR HIGH THAT'S GOING TO BE ON KRAMER, AND HE WAS NOT EVEN AWARE THAT ALL THAT GIANT DRAINAGE REALLY COALESCES TO THIS TINY LITTLE PINCH POINT, WHICH IS ESSENTIALLY FORMING A DAM AT OUR PROPERTY AND NOT ALLOWING ALL THAT INCREASED WATER FLOW TO GO DOWN. UNDER TEXAS WATER CODE SECTION 11.086, IT IS ILLEGAL TO DIVERT OR IMPOUND THE NATURAL FLOW OF SURFACE WATERS IN A MANNER THAT DAMAGES THE WATER OF ANOTHER, AND REPLACING THE CULVERTS WITH INADEQUATELY SIZED CULVERTS WOULD VIOLATE THIS LAW. THE CITY'S CURRENT ACTIONS ARE CREATING PROBLEMS BY BOTH DIVERTING AND IMPOUNDING WATER FLOW ONTO OUR PROPERTY, CAUSING POTENTIAL FLOODING AND DAMAGE.
ALL OF THE NEWER SUBDIVISIONS NORTH OF THESE CULVERTS BROOKSIDE ESTATES, GRAYHAWK PARK, KRAMER ET CETERA. AND SOON THIS NEW JUNIOR HIGH, WHICH, ACCORDING TO THAT THIRD PARTY ENGINEER, AS I WE ALSO, YOU KNOW, DISCUSSED THIS WITH HIM. HE IS GOING TO CREATE EVEN MORE RUNOFF THAN WE CURRENTLY HAVE TODAY. SO IT'S PRETTY MUCH EFFECTIVELY TURNED OUR PRIVATE

PROPERTY INTO A GIANT DETENTION POND FOR ALL THESE DEVELOPMENTS NORTH OF US, AS THEIR STORMWATER DRAINAGE ISSUES HAVE NOT BEEN MANAGED ADEQUATELY, AND THAT THE CULVERTS ARE NOT HANDLING THAT INCREASED WATER RUNOFF BY NOT UPSIZING THE CULVERTS. THE CITY WOULD BE OUT OF COMPLIANCE WITH LOCAL REGULATIONS AND ENVIRONMENTAL LAWS THAT MANDATE ADEQUATE STORMWATER MANAGEMENT TO PREVENT WATER FLOW PROBLEMS, AND PROPERLY SIZING THESE CULVERTS IS ESSENTIAL TO COMPLY WITH THESE REGULATIONS AND TO ENSURE THAT THE INCREASED WATER FLOW DOES NOT CAUSE DAMAGE TO NEIGHBORING PROPERTIES. CURRENTLY, THESE CULVERTS ON EASTERN ROAD CONSIST OF TWO SIX FOOT ROUND STRUCTURES. PRIOR TO THE DEVELOPMENT OF GREYHAWK PARK NEIGHBORHOOD, THAT FARMLAND IN THAT AREA WAS ONLY SERVICED BY THREE SMALL THREE FOOT CULVERTS. THESE WERE REPLACED WHEN THEY BUILT GREYHAWK WITH SEVERAL LARGE TEN FOOT CULVERTS, WHICH IS WHY YOU HAVE SO MUCH MORE WATER GOING ONTO OUR PROPERTY AND THEN BEING BLOCKED BY THOSE SMALLER CULVERTS. SO EVERY BIT OF THAT WATER FROM EVERY ONE OF THOSE PROPERTIES GOES RIGHT INTO OUR FRONT YARD. AND THEN GETS BLOCKED AT THE CULVERTS ON STONE, WHICH IS JUST CAN'T HANDLE THAT STORMWATER RUNOFF.YOU MAY BE AWARE THAT WE DID HIRE AN ENGINEER, THE SAME ONE THAT DID THE KROGER DEVELOPMENT IN WYLIE TO EVALUATE THE HYDROLOGY STUDY FOR THE GREYHAWK PARK NEIGHBORHOOD. AND THIS ENGINEER, HE SAID THE NUMBERS WERE MANIPULATED TO MAKE IT APPEAR THAT A DETENTION POND WAS NOT NECESSARY. WE MET CHRIS HOLSTEAD, AND HE SAID THAT, YOU KNOW, WE'RE HOPING TO FIND A SOLUTION. BUT HOWEVER, HE WE WERE DISAPPOINTED BY HIS RESPONSE THAT HE SAID, WELL, SUE US. THAT'S WHY WE HAVE INSURANC. WE HAVE BEEN ADVISED THAT APPROPRIATELY SIZED CULVERTS WOULD SIGNIFICANTLY ALLEVIATE THE ISSUES CAUSED BY INCREASED DEVELOPMENT NORTH OF OUR PROPERTY. ADDRESSING THE MATTER PROMPTLY WILL HELP PREVENT FURTHER FLOODING AND A LOT OF THESE ISSUES. THERE HAVE BEEN SOME CONVERSATIONS FROM SOME QUARTERS AT THE STATE LEVEL TO MOVE TOWARDS A HOUSTON MODEL WHERE THERE IS NO ZONING ANYWHERE AND WHATEVER ANYONE WANTS TO BUILD, THEY CAN BUILD AS LONG AS THEY OWN THE LAND. THIS WOULD JUST BE TO OPPOSE THAT AND TO KEEP THE AUTHORITY OVER ZONING WITHIN THE CITIES, REDUCTION OR ELIMINATION OF ETJ ETJ JURISDICTIONS. IF THERE'S NO ZONING AUTHORITY. I KNOW THIS IS SOMETHING WE'VE TALKED ABOUT AS A BODY IN THE PAST. IF ALL ETJ GOVERNANCE IS STRIPPED FROM US BY THE STATE, THEN NOT KEEPING THOSE ETJ AREAS WITHIN THE CITIES AND INSTEAD TURNING THEM TO THE COUNTIES, WHICH YOU WILL SEE WHY. IF I'LL SKIP DOWN A COUPLE TO INSTEAD ENACT COUNTY WIDE ZONING AUTHORITY IN AREAS OUTSIDE OF CITY LIMITS. SO IF WE CAN'T HAVE ANY SAY, TURNING THAT OVER TO THE COUNTY, SINCE IT'S COUNTY LAND THAT ALSO LISTS MUNICIPAL, UTILITY DISTRICT OR MUD REFORM. SO AGAIN, THIS IS ABOUT ATTEMPTING TO ENSURE THAT WHEN MUD DEVELOPMENTS GO IN THAT THEY HAVE FIRE, THEY HAVE POLICE, THEY HAVE TRASH SERVICE, THEY HAVE ROADWAY CONNECTIONS THAT ARE SUFFICIENT FOR THE NUMBER OF NEW HOMES BEING BUILT. THERE'S INFORMATION, I BELIEVE IN, THERE'S FURTHER INFORMATION THAT CAN BE PROVIDED. BUT THIS IS JUST TO ENSURE THAT WHEN THOSE ARE PUT IN, THE CITY DOES NOT GET LEFT TRYING TO ALWAYS DETERMINE HOW WE'RE GOING TO DO MUTUAL AID AGREEMENTS AND THINGS LIKE THAT, WHERE THOSE THINGS ARE WORKED OUT IN ADVANCE BECAUSE OBVIOUSLY IT PUTS A STRAIN ON CITY RESOURCES. IF WE HAVE VEHICLES AND PERSONNEL OUTSIDE OF THE CITY LIMITS AIDING ALSO IT HAS HERE RETAINING THE RIGHT TO CHARGE CITY IMPACT FEES. AGAIN, THIS IS DRIVEN BY THE DEVELOPER LOBBY WHO WOULD LIKE TO REMOVE ALL DEVELOPMENT FEES OR CITY IMPACT FEES, WHICH AGAIN, THOSE ARE FEES THAT WE USE TOWARDS ROADWAY CONSTRUCTION, PARKLAND DEDICATION AND IMPROVEMENTS. I BELIEVE THERE'S SOME THAT GOES TO THE FIRE. IS THAT CORRECT AS WELL? IN CERTAIN? OKAY. NOT FIRE I KNOW THERE'S DIFFERENT IMPACT FEES, BUT THERE ARE SEVERAL OF THEM. AND IT'S JUST AGAIN, ABOUT RETAINING THE RIGHT FOR THE CITY TO OVERSEE THAT. NOT IN THE COUNTY. YES. YEAH. AND THE GREAT POINT THIS IS NOT ABOUT CHARGING IMPACT FEES OUTSIDE OF THE CITY.THIS IS JUST FOR DEVELOPMENTS AGAIN WITHIN THE CITY LEAVING LOCAL CONTROL IN PLACE. AND THEN FOR THE LAST ONE HERE OR THERE WAS ALSO ADDRESSING TEXAS WATER CHALLENGES. WE CONTINUE TO HAVE MASSIVE POPULATION INFLUXES INTO THE STATE. I THINK WE ALL WANT TO MAKE SURE THAT WITH THE AMOUNT OF TIME THAT IT TAKES IN ORDER TO GET CLEAN WATER SOLUTIONS IN PLACE, THAT THAT IS SOMETHING THAT THE STATE IS PLANNING FOR. AS COLLIN COUNTY CONTINUES TO GROW IN SIZE.
OBVIOUSLY, WE'RE HOME TO THE NORTH TEXAS MUNICIPAL WATER DISTRICT. THIS IS ON THEIR PLATE. I CAN TELL EVERYONE THAT WITH THE EXCEPTION OF IMPACT FEES BEING DIRECTLY MENTIONED, ALL OF THESE HAVE ARE GAINED UNANIMOUS SUPPORT AT THE RTC, WHICH IS THE REGIONAL TRANSPORTATION COUNCIL, MADE UP OF 45 INDIVIDUALS FROM ACROSS A 12 COUNTY AREA. SO THESE THESE ARE SEEN FROM PEOPLE, I'LL PUT IT AS BLUE AND RED LOCATIONS. SEE THESE THINGS AS IMPORTANT TO BE FOCUSED ON IN THE UPCOMING LEGISLATIVE SESSION. IMPROVING THE PROTECTION FOR ELDERLY WITH RESPECT TO CARETAKER RELATIONSHIPS AND THEIR ATTEMPTS TO ABSCOND WITH FINANCIAL ASSETS. ET CETERA. OVER THE LAST FEW YEARS, WE'VE SEEN AN UPTICK IN FINANCIAL CRIMES AGAINST ELDERLY, MENTALLY HANDICAPPED OR YOUTH WHO HAVE BEEN REMOVED FROM THEIR HOMES AND PLACED INTO STATE SERVICES OR STATE SERVICE ORGANIZATIONS.
AND SO I HAVE BEEN WORKING ALREADY WITH SOME OF OUR LEGISLATORS, BOTH IN AUSTIN AND AT THE FEDERAL GOVERNMENT LEVEL, TO IMPROVE THOSE LAWS AND STRENGTHEN THOSE LAWS, TO ENSURE THAT AS OUR AGING COMMUNITY DOES BEGIN TO CREEP UP, TO BE THE LARGEST SECTOR OF OUR COMMUNITY, THAT THERE ARE LAWS IN PLACE TO PROTECT THEIR ASSETS ON BEHALF OF THEIR FAMILIES AND TO ENSURE THAT THEY'RE NOT PREYED UPON BY CARETAKERS WHO ARE ACTUALLY PREDATORS. SO IN ADDITION TO THAT, WE'RE ALSO LOOKING AT STRENGTHENING THE ELDER. FINANCIAL ABUSE LAWS TO ENSURE

THAT WHEN NON CARETAKERS COME IN AND BEGIN TO SCAM ELDERLY FOLKS OUT OF MONEY, THAT WE STRENGTHEN THE LAWS TO A POINT WHERE IT DISSUADES THEM FROM TAKING ACTIONS LIKE THAT, OR ONCE THEY'RE CAUGHT, IT'S NOT A SLAP ON THE WRIST AND GO DOWN THE ROAD.
