WELCOME THIS IS THE WILY ZONING BOARD OF ADJUSTMENTS. REGULAR MEETING NOVEMBER 20TH 2023 AT SIX PM THE COUNCIL CHAMBERS. AND WIDELY TEXAS. I LIKE TO CALL THIS MEETING TO ORDER. NO. ARE THERE ANY COMMENTS? ON NON AGENDA ITEMS. HEARING NONE. WE WILL MOVE TO THE CONSENT AGENDA.

WE NEED APPROVAL OF THE MEETING MINUTES FROM SEPTEMBER, 18TH. DO I HAVE A MOTION TO MAKE A MOTION? WE APPROVE THE MINUTES I'LL SECOND IT. OKAY, LET'S HAVE A VOTE.

MOTION HAS PAST 50. OKAY, NOW WE'LL GO TO THE REGULAR AGENDA. TO HOLD A PUBLIC HEARING TO CONSIDER AND ACT UPON A REQUEST BY CHARLES R. TAYLOR FOR VARIANTS TO SECTION 5.2 0.18 A PLAN DEVELOPMENT. 2002-52 TO ALLOW FOR AN ACCESSORY STRUCTURE WITH A 1 FT PROXIMITY SET BACK TO THE MAIN STRUCTURE IN LIEU OF THE REQUIRED SETBACK OF 5 FT. THE PROPERTY IS LOCATED AT 130 TO TERRAN TRAIL. G B H 2023-08. GOOD EVENING. THE APPLICANT IS REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 1302 TEARING TRAIL. TO ALLOW FOR AN ACCESSORY STRUCTURE WITH 1 FT PROXIMITY SETBACK IN LIEU OF THE 5 FT REQUIREMENT THAT 5 FT REQUIREMENT IS SET BY THE PLANNED DEVELOPMENT OF BOZEMAN FARMS. THE APPLICANT HAS RECEIVED AN H O A APPROVAL LETTER FROM BOZEMAN FARMS PENDING THE CITY'S APPROVAL OF THE VARIANCE IN ANY ADDITIONAL BUILDING PERMITS THAT MAY BE REQUIRED. UM THE BUILDING MEASURES EIGHT BY 10. THAT'S APPROXIMATELY 80 SQUARE FEET. AND IT'S REPLACING AN EXISTING SHED THAT WAS ONCE LOCATED ON THE PROPERTY. IT'S USING THE SAME PAD SITE. UM, AS YOU CAN SEE IN THE IMAGES SHOWN ON THE PROJECTOR. WE DID MALE 32 NOTICES TO THE SURROUNDING PROPERTIES, AND WE RECEIVED THREE IN FAVOR. ONE WAS RECEIVED AN OPPOSITION NOTE THAT IT WAS OUTSIDE OF THE NOTIFICATION AREA AND IT WASN'T EVEN WITHIN THE SAME SUBDIVISION. UM WITH THAT, I'LL BE HAPPY TO ANSWER ANY QUESTIONS, AND THE APPLICANT IS ALSO HERE. DID YOU SAY THAT? DID YOU SAY THAT WAS. THAT BOZEMAN FARMS SET THE SETBACK. BOZEMAN FARMS, UH, THE PLAN DEVELOPMENT. SETS THE 5 FT. BESIDES PROXIMITY SETBACKS, SO WITHIN THE DESIGN STANDARDS OF THE P D, THERE'S A 5 FT REQUIREMENT FOR THE PROXIMITY. OKAY, BUT IT WAS THE CITY THAT ACTUALLY DID IT. FOR BOTH MEN FORMED SUBDIVISION. NO, NO, NO. YOU KNOW WHEN THE BACK IN 2002 WHEN BOZEMAN UM THE ORIGINAL DEVELOPERS, A POSTMAN FARMS UM BROUGHT THE PD FOURTH. THEN THEY PROPOSED THAT 5 FT SETBACK FROM THE BUILDING. AND THAT'S JUST IT WAS PART OF THE PLAN DEVELOPMENT RULES, WHICH ARE SEPARATE FROM THE ZONING ORDINANCE RULES. AND NOW THE H O A IS OKAY WITH OBVIOUSLY 21 YEARS LATER. SO THE ONE THAT WE RECEIVED THE OPPOSITION FOR IS EVEN OUTSIDE LIKE IT WAS NOT. IT'S NOT EVEN WITHIN THE 200 FT.

THEY WILL SEND THE NOTICES, TOO. SO HOW DID THEY RESPOND TO IT? SO LIKELY THEY RECEIVED THE NOTICE BECAUSE WE, THE CITY DID START A NEW Q R CODE PROCESS. SO IT'S IF THEY HAVE THE CODE THE QR CODE AND THEY CAN PROVIDE COMMENTS. AS YOU CAN SEE IN THE COMMENT THAT THEY PROVIDED IT DOESN'T MENTIONED THE PROPERTY. UM IT MENTIONS JUST TRAFFIC AND HIGHER POPULATION WITHIN THE CITY. SO YEAH. SO JUST SO YOU ALL KNOW WHAT WE'VE WE'VE DONE IS, UM AND ACTUALLY LILLIAN WAS THE ONE WHO CAME UP WITH THE I MEAN IT'S BEEN A GREAT IMPROVEMENT TO OUR TO OUR

PROCESS, BUT UM IT. THE GOOD NEWS IS AND THIS IS THE WAY IT SHOULD BE, IS THAT MORE PEOPLE HAVE THE OPPORTUNITY TO SEE WHAT'S GOING ON WITHIN THE CITY BECAUSE IT'S MORE EXCEPT THE INFORMATION IN THE DIFFERENT ZONING CASES AND ALL THAT ARE MORE ACCESSIBLE TO ALL OF OUR CITIZENS. WHICH IS THE WAY IT SHOULD BE. ONE ISSUE THAT CAN COME UP WITH THAT, THOUGH, IS THAT ANYBODY CAN COMMENT ON ANYTHING. WHERE MOST PEOPLE WOULDN'T EVEN HAVE KNOWN.

UNFORTUNATELY THAT YOU KNOW THAT THIS PARTICULAR THING WAS TAKING PLACE. YOU KNOW, SO, UM, SOMETIMES YOU GET COMMENTS THAT MAYBE AREN'T NECESSARILY AS RELEVANT. UM AS MAY NORMALLY BE, BUT, UM, OVERALL, IT'S YOU KNOW, IT'S GOING TO BE A DEFINITE IMPROVEMENT TO OUR PROCESSES GOING FORWARD IN THE LONG TERM. ONE THING I ALSO WANT TO NOTE IS THAT FOR ANY FUTURE CASES, I USUALLY PUT A CHECK MARK OR AN EX DEFENDING THAT IF IT IS WITHIN THE NOTIFICATION AREA, AND THAT GIVES YOU A GOOD VISUAL TO KNOW IF THERE'S ANY NEIGHBORS THAT ARE DIRECTLY AGAINST THE VARIANCES OR NOT. SO JUST TO BE PERFECTLY CLEAR. THE THREE THAT WERE FOR IT ARE INSIDE. THE NOTIFICATION AREA AND THE H O A HAS GENERALLY IS, YEAH, HE'S THE APPLICANT HAS ALREADY GONE TO THE H O AND GOT THEIR APPROVAL PENDING CITY APPROVAL OF THE OF THE VARIANTS.
